How the Law Changes to Meet the Changing Needs of Society

Have you ever wondered how the law keeps up with the changing world?  Well, this is a summary of how that happens.

The law is made either (1) by Courts (called The Common Law) or (2) by the Legislature (called Statutory Law).  Courts do this through their decisions in individual cases.  The State Legislatures and Congress meet and enact statutes.

Courts change the Common Law when the needs of society call for change.  They do this in their case decisions, one case at a time.  Our law-firm has been involved in that process in representing clients in individual cases and have successfully asked Courts for changes and clarifications in the law to meet the changing needs of society.

One area where huge change came about in the Common Law, and later in the Statutory Law, occurred mostly in the 1950-1980s in what is called product liability law.  The law changed to hold manufacturers of defective products liable for the injuries their products cause.  Before then, a manufacturer was only liable to a person it had sold the product to directly.  However, our society had gotten to where products were sold mostly by “middle men”, so that manufacturers escaped responsibility where their defective products caused injuries.

Some lawyers recognized the situation and began urging courts to change the law and make manufacturers responsible for the harm that their products caused.  The courts recognized the need for change and issued decisions imposing a duty on manufacturers to produce safe products.  Many cases were tried over many years throughout the U.S. in order to bring about the law that we have today, which does a good job of protecting the public from defective products.  Not surprisingly, when manufacturers became liable for harm caused by their defective products, the products became safer.
